PRESS RELEASE: Caucus Reform Bill Set to Cause Collateral Damage

The Pirate Party along with many others in Canada were excited to hear about MP Michael Chong’s bill to reform the party caucuses. After reading the text the party sent an email to Michael Chong’s office regarding a section of the language regarding requirements for EDAs (Electoral District Associations) to choose party candidates as it seemed this would block candidates if their party didn’t have an EDA in their riding. Michael Chong’s office replied:

Michael is open to friendly amendments that would address this issue, although we understand that it only takes 4 members to form an EDA and the financial agent requirement can be done centrally or regionally. Michaels intention is only to take the requirement away from Party leaders not to make it more difficult for parties to run a candidate.

In short the bill’s language implies that if a party lacks an EDA it will not be able to run a candidate but this was not his intention. While this is a relatively unimportant issue for the major parties it is a significant setback for smaller parties who may only have their candidate in a riding when an election is called. The result is a party potentially cannot run in as many ridings as would otherwise be the case. While founding an EDA sounds like a small issue, minor parties don’t need the extra paperwork. The simplest amendment to fix this issue would be to only apply the new rules to parties with representation in parliament.

“I’m sure people would be inclined to scoff at this problem. Afterall, who cares if a parties that collectively receive less than 1% of the vote are disadvantaged? This view is short-sighted. In living memory we have seen Progressive Conservatives reduced to a single digit seat count, the Bloc Quebecois implode, and both the Liberals and NDP swing widely in seat totals. I’m sure there were some EDAs that got de-registered through all that. This bill could potentially make party recoveries more difficult while at the same time making it harder for new parties to start. We also currently have the Green Party which has had to deregister some of its EDAs. It may have willing candidates to run a full slate next election but it is unclear if they would be able to do so with the proposed law in effect. Perhaps most damning is that it would limit democratic choice needlessly”, says James Wilson, Leader of the Pirate Party of Canada. The Pirate Party supports reducing the power of party leaders over their caucuses. The complete suppression of dissent is not healthy for Canadian democracy. However, making democracy easier in one part of Canadian politics while making it harder in another is not a positive step forward. Hopefully another member of Parliament will see that fixing this flaw is necessary and introduce an amendment. Perhaps, Elizabeth May as her Green Party most risks losing the gains they have made.

  1. From the Constitution of the Federalist party of Canada

    10.5 There shall be a Federal Election Officer (FEO). This officer shall be responsible for the conduct of all national and nomination elections and the administration of the Party’s voters list.

    10.6 The Federal Election Officer is elected by a two-thirds majority vote of the National Congress in regular session with a concurring two-thirds majority vote of the National Assembly. This officer can be removed by the same vote in the Assembly and Congress. The term of office shall be for 10 years.

    I would change Mr Chang’s bill to have every registered political party have a Chief Election Officer with a term of ten years. Just like they must have an auditor.

    There would be two classes of registered parties. The major parties are those that won 4 seats or more or ran candidates in a majority of the ridings. That would be the following 5 parties Con, NDP, Lib, Bloc, and Green. The minor parties are all the other registered parties numbering 13 out of the 18 registered parties.

    The major parties elect their CEO by a secret ballot of a caucus of their candidates in the last election. For the Conservatives, NDP, Liberals, and Greens this caucus is 300 plus members. The Bloc is a caucus of 75. It requires a two-thirds majority to elect and the same to suspended or dismiss.

    The minor parties elect the CEO by a secret ballot of their membership. As with the major parties it requires a two-thirds majority to elect and the same to suspend or dismiss.

    The vote is Yes / No for each candidate. If no candidate gets the required two-thirds majority the term is for 1 year.

One of our main founding principles was Open Government. This means an Open Data policy with proactive disclosure and free access to government data. This will allow anyone to scrutinize and catch any error, negligence or corruption early on. Open Government also means increased transparency, and giving constituents real voices. Unemployment and income inequality is on the rise and we risk a breakdown of social cohesion without a system for resource distribution as we face increased automation. We're shifting from a bureaucratic culture of constant work-demands to a culture of passion, joy, and learning for the sake of learning.

3. Autonomy and Decentralization

We believe that the world works best when individuals are making informed decisions. It is our goal to get all information to all people, so they may be more informed voters, consumers, participants, and teachers. We do not need to force information culture & the hacker ethic onto people we can simply allow them to choose access. We believe the right to choose our identity, name, and appearance is inalienable.

4. Copyright and Patent Reform
Copyright and patent's main purpose was for propagation of culture and innovation. Our current copyright and patent laws are continuously being corrupted due to lobbying by copyright and patent monopolist. These monopolist refuses to innovate and provide wider access and pass on the savings from the new lower distribution cost. Instead the copyright and patent terms keeps getting extended to benefit the few to the detriment of the public interest. The opposite should happen. Copyright and patent terms should be shortened since our new information infrastructure (i.e. the internet) have brought us cheaper and faster means of distributing media contents and information. Mandatory licensing, owner's rights to a non-DRM product, open access to research data and shorter copyright term are some of the natural changes that is needed if we want to create a more open and progressive society. This will ensure future artist and innovator are not hampered by patent and copyright gatekeepers who uses rent seeking law for anti-competitive purposes.

Human beings increasingly have a moral duty to share information with one another. Libraries are stuck in the last century, enforcing artificial scarcity on digital content. If libraries were upgraded for the modern age, we would no longer need filesharing. And let's face it, watching and listening to whatever you want to is fun. It breaks down arbitrary global borders of access and creates a global culture defined by people- not by corporations.

Our democracy need a serious upgrade and Pirate Party aims to change politics to the way it should be.
